General Terms and Conditions of PUH MAJ J.MAJ
§1 Applicability to Entrepreneurs and Definitions
1. The following General Terms and Conditions apply to all deliveries between us and a consumer or entrepreneur (§ 13) — hereinafter referred to as the “Customer” — in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or self-employed professional activity (§ 12).
2. You may shop at the DERMOeco Online Store if you are at least 18 years old.
§2 Conclusion of Contract, Storage of Contract Text

3. The presentation of products in our online shop does not constitute a legally binding offer but rather a non-binding invitation for the Customer to place an order. By ordering the desired product, the Customer submits a binding offer to enter into a purchase contract.
4. Upon receipt of an order via our online shop, the following applies:
The Customer makes a binding offer to enter into a contract by successfully completing the ordering process provided in our shop.
The ordering process includes the following steps:
1. Selecting the desired item(s)
2. Clicking the "Order" button
3. Reviewing the shopping cart contents
4. Clicking the "Checkout" button
5. Entering personal information (name, address, email)
6. Reviewing or correcting the entered data
7. Submitting the order by clicking “Place binding order” or “Buy”
The Customer can review and correct any entered data using the “Back” function of their browser before submitting the order or cancel the order process by closing the browser window.
We confirm receipt of the order immediately with an automatically generated email ("Order Confirmation"). This confirmation constitutes our acceptance of your offer.
5. Storage of contract text: We store the contract text and will send you the order details and our Terms and Conditions by email. You can view the Terms and Conditions at any time at dermoeco.de. Past orders can be viewed in the customer area under "My Account → My Orders".
6. Right of Withdrawal: If we are permanently unable to deliver due to circumstances beyond our control (e.g. force majeure or non-delivery by our suppliers despite proper arrangements), we reserve the right to withdraw from the contract. We will inform the Customer immediately and refund any payments already made.
§3 Prices, Shipping Costs, Payment, Due Date
1. All stated prices include statutory VAT and other pricing components. Shipping is free for orders over €200. The current price and service overview can be viewed at dermoeco.com
2. The Customer can choose to pay via:
◦ Prepayment (SEPA transfer)
◦ Credit Card (Visa, Mastercard)
◦ Google Pay
◦ Apple Pay
Other payment methods are not accepted.
The invoice amount must be transferred in advance upon receipt of the invoice (sent via email). If using a payment service provider, that provider facilitates the transaction between the buyer and seller.
For credit card payments, the cardholder must be the Customer. The card is charged before the goods are dispatched.
3. If prepayment is selected, the Customer is obligated to pay immediately after conclusion of the contract. If cash on delivery is selected, payment is due upon receipt of the goods.
§4 Delivery
1. Unless otherwise stated in the product description, items are ready for dispatch within 24 hours. If the deadline falls on a Saturday, Sunday, or public holiday, it is extended to the next working day.
2. Risk of accidental loss or deterioration of the goods passes to the Customer only upon handover, even in the case of shipping.
§5 Retention of Title
We retain ownership of the goods until full payment is received.
For business customers: Ownership remains with us until all claims from the ongoing business relationship are settled. Reselling is allowed in the ordinary course of business. Resulting claims are to be assigned to us in advance up to the invoice amount.
§6 Right of Withdrawal for Consumers
Right of Withdrawal
Consumers have the right to withdraw from this contract within 14 days without stating reasons.
The withdrawal period is 14 days from the day you or a third party (not the carrier) receive the goods.

By a clear statement (e.g. letter or email) of your decision to withdraw from the contract. You may use the enclosed sample withdrawal form but are not required to do so.
Consequences of Withdrawal:
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except additional costs for other than standard delivery), within 14 days from the day we receive your withdrawal notice. We use the same payment method unless otherwise agreed. You will not be charged for the refund.
We may withhold the refund until we have received the goods back or you have provided proof of return, whichever is earlier.
Return Policy:
You may return any product within 95 days of receipt, provided it is complete, unused, and undamaged. Sealed items must be returned unopened with the seal intact.

§8 Warranty
1. The statutory liability for defects applies. Any applicable additional guarantees are outlined in the product description or on the website.
2. For entrepreneurs:
You must inspect the goods upon delivery and notify us of any defects within 7 days. Timely dispatch is sufficient for compliance. This also applies to hidden defects from the time of discovery.
If the inspection and notification duties are not fulfilled, warranty claims are excluded. We may choose to remedy the defect or provide a replacement. If remediation fails twice, the buyer may reduce the price or withdraw from the contract. Warranty period for entrepreneurs: 1 year.
§9 Disclaimer of Liability
1. Damage claims by the Customer are excluded, unless stated otherwise. This also applies to representatives and agents of the provider. Exceptions include injury to life, body, health, or essential contractual obligations, and damages due to gross negligence or intentional breaches.
2. Assignment or pledging of claims to third parties is not permitted.
§10 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/
We are not obligated or willing to participate in dispute resolution before a consumer arbitration board.

§12 Language, Jurisdiction, Applicable Law
The contract is in English. Further communications will be in English. Only Polish law applies. For consumers, this applies only if it does not restrict mandatory laws of their country of residence.
Jurisdiction for disputes with non-consumer customers is the provider’s place of business.
§13 Final Provisions
If you are a business customer, Polish law applies excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules.
If you are a merchant under the Commercial Code, a public legal entity, or special public fund, exclusive jurisdiction is our place of business.
§14 Severability Clause
If any provision of these Terms is invalid, the remaining provisions remain unaffected.
