1. The Customer is asked to check the package at the courier in order to verify that the consignment has no damage resulting from transport, is intact and consistent with the order. In the case of damage to the package, incompleteness or non-compliance of the package with the order, the Customer is asked to write a damage protocol in the presence of the courier and immediately report this fact to the Seller.
2. Pursuant to the Act of 31.05.2014 on consumer rights (uniform Journal of Laws of 2017, item 683 as amended), the Customer making a purchase as a consumer has the right to withdraw from the sales contract and return the purchased goods within 14 days from the date of receipt of the shipment, subject to the restrictions on medicinal products and medical devices.
3. Medicinal products and medical devices can be returned to the online store only due to quality defects or improper issue, in accordance with Article. 96.6 of the Act of 06.09.2011. Pharmaceutical Law (uniform Journal of Laws 2017, item 2211 as amended).
4. In the case of withdrawal from the sales contract the Seller shall return to the Consumer all payments received from him, including the costs of delivery of goods (except for additional costs arising from the chosen by the Consumer way of delivery other than the cheapest ordinary way of delivery offered by the Seller), immediately, and in any case no later than 14 days from the date on which the Seller was informed of the Consumer's decision to exercise the right of withdrawal from the sales contract. Reimbursement of payments will be made by the Seller using the same methods of payment that were used by the Consumer in the original transaction, unless the Consumer has explicitly agreed to another solution; in any case the Consumer will not incur any fees in connection with this reimbursement.
5. The Seller may withhold the reimbursement until receipt of the products or until proof of their return is provided to him, whichever event occurs first. Goods returned in the manner specified in pt. 2 should be delivered (sent back) to the store together with the proof of purchase and the warranty card (for products with warranty cards). 6. The consumer is responsible only for diminution in value of the returned goods resulting from using them in a manner other than necessary to determine the nature, characteristics and operation of the products.
7. For 2 years from the date of purchase, the Seller shall be liable to the Customer under the warranty, pursuant to the provisions of the Civil Code, in particular Articles 556 and 556(1) - 556(6) of the Civil Code. If the buyer of the goods is not a consumer, the liability of the seller under the warranty is excluded on the basis of art. 558 § 1 Civil Code.
8. The time in which the online store considers complaints should not exceed 14 days. During this time the customer will be notified of the decisions made by the store and the possible exchange or refund.
9. All costs associated with a justified complaint is covered by the online store.
10. Complaint and warranty do not apply when the purchased products show mechanical damage.
11. The Seller informs that it agrees to resolve consumer disputes under the Act of 23 September 2016 on extrajudicial resolution of consumer disputes (Journal of Laws 2016, item 1823). If the complaint is not acknowledged by the Seller, the Consumer may use the out-of-court ways to resolve complaints and pursue claims and request the intervention of the Provincial Inspectorate of the Trade Inspection in Kielce, 76 Sienkiewicza Street, 25-950 Kielce, postal skr. no. 347, http://www.wiihkielce.prot.pl Detailed procedures for using the assistance of the Trade Inspection are available on the website of the office and on the website www.uokik.gov.pl under "Resolution of consumer disputes" and "Important addresses". Out-of-court settlement of claims after the complaint procedure is free of charge. In the case of the Purchaser who is a Consumer who wants to use the out-of-court settlement of claims, there is an additional possibility to file a complaint via the EU online ODR platform, available at http://ec.europa.eu/consumers/odr/.
